OPINION

WILKINSON, Circuit Judge:

Appellants Nationstar Mortgage, LLC and David Gaither appeal the district court's judgment affirming the bankruptcy court's grant of summary judgment to debtor-appellee Stephen Cooks on his dischargeability complaint. The bankruptcy court ruled that two notes secured by mortgages held by the National Bank of Greece and NationsBank had been discharged in Cooks' prior Chapter 7 bankruptcy. Because these two mortgage notes were not included in the bankruptcy discharge, the district court's judgment must be reversed.

This case arises out of the Cooks' effort to build a house at their North Carolina residence. Cooks has a separate Chapter 7 bankruptcy pending in the Eastern District of North Carolina. Several private lenders financed the construction of the house. They included a $ 0b46394aab
